Malawi D-MVIC Platform - Terms and Conditions

 

Introduction 

Insurance Association of Malawi (referred as “IAM” from here onwards) is the owner of the related websites, mobile apps platforms under the brand of D-MVIC.

DMVIC Stands for Digital Motor Vehicle Insurance Certificate. The DMVIC application provides users with a simple interface to manage the Motor Insurance Certificate process.

This Privacy Policy describes how DMVIC Platform collects and handles certain information it may collect from you via the use of this website/Mobile app. 

Please see below for details on what type of information we may collect from you, how that information is used in connection with the services offered through our website and relevant information.

This Privacy Policy applies to current and former visitors to our website and our customers. By visiting and/or using our website, you agree to this Privacy Policy.

 

 

 

Definitions

In these Terms and Conditions of Use, the following capitalized terms shall have the following meanings, except where the context otherwise requires:

“IAM” means Insurance Association of Malawi, consultative and advisory body for the Malawi Insurance Industry.

"Account" means an account created by a User on the Web Application as part of Registration.

“DMVIC” means Digital Motor Vehicle Insurance Certificate.

“Certificate” / “Digital Certificate” means certificate of motor insurance issued by the Insurance Company.

“Insurance Company” means the company from which you have purchased the motor insurance policy.

"Privacy Policy" means the privacy policy set out in these Terms and Conditions of Use.

"Register" means to create an Account on the Web Application

"Registration" means the act of creating such an Account.

"Services" means all the services provided by IAM via the Web Application to Users, and "Service" means any one of them,

"Users" means users of the Web Application, including you and "User" means any one of them.

Personal Information
 To meet the purpose and objectives of the system, your personal data will be collected and stored by IAM. 

What Type Of information we collect? 

We may collect certain information which may be personal to you such as name, email id, mobile number, etc. We collect your non personal information such as geographical location, time zone for analytical purposes.

This information will be provided to the IAM and the respective insurance company.

 

 

 

 

Licence to use website.

 

You may:

 

(a) view pages from the DMVIC website in a web browser.

 

(b) download pages from the DMVIC website for caching in a web browser.

 

(c) print digital certificates & pages from the DMVIC website.

 

(d) stream audio and video files from the DMVIC website; and

 

(e) use DMVIC website services by means of a web browser,

 

You may only use the DMVIC website for business purposes only, and you must not use our website for any other purposes.

 

Except as expressly permitted by these terms and conditions, you must not edit or otherwise modify any material on the DMVIC website.

 

You must not:

 

(a) republish material from the DMVIC website (including republication on another website);

 

(b) sell, rent or sub-license material from the DMVIC website.

 

(c) exploit material from the DMVIC website for a commercial purpose; or

 

(d) redistribute material from the DMVIC website.

 

You may redistribute the digital certificate in print and electronic form to the concerned person (i.e., Policy Holder/Insured Person).

 

We reserve the right to restrict access to areas of the DMVIC website, or indeed the whole DMVIC website, at our discretion; you must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on the DMVIC website.

 

 

 

 

 

 

 

 

 

Acceptable use

 

You must not:

 

(a) use the DMVIC website in any way or take any action that causes, or may cause, damage to the DMVIC website or impairment of the performance, availability, or accessibility of the DMVIC website.

 

(b) use the DMVIC website in any way that is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.

 

(c) use the DMVIC website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit, or other malicious computer software.

 

(d) conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to the DMVIC website.

 

(e) access or otherwise interact with the DMVIC website using any robot, spider, or other automated means.

 

(f) use data collected from the DMVIC website for any direct marketing activity (including without limitation email marketing, SMS marketing, telemarketing, and direct mailing).

 

You must not use data collected from the DMVIC website to contact individuals, companies or other persons or entities.

 

You must ensure that all the information you supply to us through the DMVIC website, or in relation to the DMVIC website, is true, accurate, current, complete, and non-misleading.

 

Registration and accounts

 

To be eligible for an account on the DMVIC website, you must receive an account activation invitation from IAM or the Insurance Company.

 

You may register for an account with the DMVIC website using the account activation code sent to your official email address & by completing the account activation process on the DMVIC website.

 

You must not allow any other person to use your account to access the DMVIC website.

 

You must notify us in writing immediately if you become aware of any unauthorised use of your account.

 

You must not use any other person's account to access the DMVIC website.

 

User login details

 

If you register for an account with the DMVIC website, we will provide you with a user ID & you will be asked to choose a password.

 

You must not use your account or user ID for or in connection with the impersonation of any person.

 

You must keep your password confidential.

 

You must notify us in writing immediately if you become aware of any disclosure of your password.

 

You are responsible for any activity on the DMVIC website arising out of any failure to keep your password confidential and may be held liable for any losses arising out of such a failure.

 

Cancellation and suspension of account

 

We may:

 

(a) block your account.

 

(b) deactivate your account; or

 

(c) edit your account details,

 

at any time in our sole discretion without notice or explanation.

 

You may deactivate your account on the DMVIC website by raising a request to the DMVIC system admin.

 

 

Breaches of these terms and conditions

 

Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may:

 

(a) send you one or more formal warnings.

 

(b) temporarily suspend your access to the DMVIC website.

 

(c) permanently prohibit you from accessing the DMVIC website.

 

(d) block computers using your IP address from accessing the DMVIC website.

 

(e) commence legal action against you, whether for breach of contract or otherwise; and/or

 

(g) suspend or delete your account on the DMVIC website.

 

Where we suspend or prohibit or block your access to the DMVIC website or a part of the DMVIC website, you must not take any action to circumvent such suspension or prohibition or blocking (including without limitation creating and/or using a different account).

 

Data Grievance

 

In case you have any grievances with respect to in accordance with applicable law on Information Technology and rules made there under.

Sharing your personal information

IAM and IAM members in the capacity of Insurance companies can view your personal information, and such information will not be shared with any third-party service providers.

Security – How do we store the data and documents?

 

We always employ appropriate technical and organizational security measures to protect the information we collect from you. 

 

We may process data on the cloud and will store the sensitive information in compliance with Malawi Data Protection laws.

 

We use multiple security (Encryption, hashing etc.) measures to protect against unauthorized or unlawful use or alteration of information, and against any accidental loss, destruction, or damage to information. 

 

Therefore, we cannot guarantee its absolute security. Further, you are responsible for maintaining the confidentiality and security of your login id and password and do not provide these credentials to any third party.

 

 

Cookies

A “cookie” is a small piece of information stored by a web server on a web browser so it can be later read back from that browser. 

Cookies are useful for enabling the browser to remember information specific to a given user.

 

Changes in our Privacy Policy

 

D-MIVC Platform reserves the right to change this policy from time to time, at its sole discretion. We may update this privacy policy to reflect changes to our information practices. We encourage you to periodically review of our Privacy Policy.

Law and jurisdiction

These terms and conditions shall be governed by and construed in accordance with the Malawi law.

Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Malawi.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.

If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
